Nod for study into native certs
KOTA KINABALU: Sabah native and local leaders have responded positively to the call by the state Malaysian Anti-Corruption Commission (MACC) to set up a task force to re-screen and regularise Native Certificates (NC).
However, they have expressed doubts over whether any suggestion to reissue NCs, especially those after 1982 (as the issuance of the certificates was stopped from that year) in Sabah was viable.
Sabah Native Affairs Council (Mheans) president Datuk Datuk Mohamad Alamin said the council and the Sabah Native Affairs Department welcomed the proposal and were willing to work with MACC and other authorities on the matter.
“We want to ensure that the task force would be capable of discharging their responsibilities and duties effectively,” he said.
He also hoped that the proposed special task force would assist the Native Court, which has the jurisdiction to review the authenticity of NCs as well as information that leads to the issuance of these documents.
“MACC can carry out investigations on the complaints they receive about falsified or dubious Native Certificates but only the Native Courts have the jurisdiction to validate such documents,” he added.
Sabah Sino Kadazandusun Murut Association (SSKA) also welcomed the proposal but said they were not sure what a false NC means.
Its president Datuk Johnny Goh said the definition was not specified and that to recall all NCs and reissue new ones would not solve the real problem.
“Native Certificates are issued by Native Courts so does this mean they were illegally issued or are we referring to imitations which passed as genuine ones?” he asked.
He also said to recall all NCs would bring about a host of new problems.
Goh said it was evident that despite the government’s decision to stop the issuance of NCs in 1982, they continued to be issued.
Among the factors that led to the falsification of these certificates was weak enforcement at the district level.
He called for stricter implementation of local laws pertaining to the issuance of these certificates.
The freezing of the NCs must be maintained and the recognition of native status must be done through birth certificates as a concrete solution to the problem, he added.
The proposal was made by outgoing Sabah MACC director Datuk Hishammuddin Hashim following the commissions investigations into a non-native who allegedly owned more than 300 customary land titles.
